Terms and Conditions for the sale of Kizala products on the Internet
References to 'us', 'we' or 'Kizala' is to Kizala Ltd as referred to in the Corporate Information Section. Every order is deemed to constitute acceptance of the following terms and conditions:
1. Ordering and Payment
1.1 The processing and delivery of an order is subject to stock availability. Should an item not be available we shall contact the customer and, wherever possible, offer an alternative.
1.2 Orders may be made using all major credit cards. Our current payment service provider is Paypal and all transactions will be processed through Paypal's secure server and PayPal will provide confirmation of the payment of your order. No financial information is received or recorded by Kizala and any issues arising from the financial processing of a transation should be directed to Paypal. Kizala accepts no liability or responsibility in respect of the same
1.3 Cheques must be made payable to Kizala Ltd. Where payment is made by cheque, we will despatch the order following clearance of the cheque.
1.4 Prices are determined by reference to the current Kizala price list at the time of acceptance of the order.
1.5 All prices shown are inclusive of VAT, where appropriate.
2.1 Subject to stock availability, we shall endeavour to despatch an order within 5 working days of a credit card order being placed, or within 5 working days of clearance of the cheque, where payment is made by cheque.
2.2 Orders for the UK will be sent by First Class Recorded Delivery Post which will require a signature upon delivery. However, please note that the First Class Service does not guarantee next day delivery and you should allow for deliveries within the UK taking up to 3 days, after the order has been despatched. Orders outside the UK will be sent by Air Mail, and we shall obtain a certificate of posting to that effect. However, we take no responsibility for non-delivery of any item if the item is sent using this method of posting. Any customer requiring delivery by International Signed For Post (which requires a signature upon delivery), must email the Company at firstname.lastname@example.org at the time of placing the order, requesting this method of shipping. In this event, additional postage charges will be due and must be settled before the order is despatched . The time taken for delivery will depend upon the Royal Mail conditions prevailing atthe time of placing the order. In normal circumstances, you should allow for a minimum of 3-4 days following the day of posting for delivery to an address in Europe and a minimum of 5 days for a delivery elsewhere in the world. Please note, however, that the time taken for deliveries to an address elsewhere in the world is dependent upon the postal services in operation in the particular country.
2.3 Times given for expected deliveries are approximate only and time shall not be of the essence for the same. Kizala Ltd shall not be liable for any delay in the delivery of any order howsoever caused.
3.1 We hope that you will be fully satisfied with any product purchased on our website. However, any item may be returned to us within 48 hours of despatch to you provided (with the exception of faulty goods) it remains in a saleable condition and in its original packaging material. Where returns are being made of non-faulty goods we will levy a handling charge of 10% of the original purchase price.
3.2 Any damage to or discrepancy with an order must be reported to us within 48 hours of your receipt of the goods.
4. Our Rights
4.1 All rights, including copyright in this website are owned by or licensed to Kizala. Any use of this website or its contents, including copying or storing it in whole or in part, other than for your own personal, non-commercial use is prohibited without the permission of Kizala. Any modification, distribution or re-posting of anything on this website is prohibited.
4.2 We reserve the right to withdraw any part of this website, temporarily or permanently and we shall not be liable to you or any third party in respect of the same.
4.3 We also reserve the right to change the Terms and Conditions of this website from time to time and your continued use of this Website shall be deemed to constitute acceptance of the same.
5. Accuaracy of Content
We will take all reasonable care to ensure that the information and data shown on our website is accurate at the time of its publication. However, we provide no guarantees, implied warranties or assurances of any kind that the site is error free and we reserve the right to make modifications at any time without prior notification.
6. Acknowledgement and Acceptance of your Order
We will notify you by email or telephone as soon as possible to confirm that we have accepted the order. At this point the contract for our sale and your purchase of the goods shall be made. No contract will be made until you receive confirmation from us that we have accepted your order.
7. Limitation of Liability
7.1 We make no warranty that this website or the server that makes the website available to you are free of viruses and we shall not be responsible for any damage or loss of content or material arising from the use of or access to this website.
7.2 We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise for:
- any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
- any loss of goodwill or reputation; or
- any special or indirect losses,
suffered or incurred by any party arising out of or in connection with the use of, or any matter arising under, this website.
Nothing herein shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
7.3 We disclaim any and all warranties of any kind, whether express or implied, in relation to any of the products appearing on our website to the fullest extent permissible under applicable law.
The validity, construction and performance of this agreement shall be governed by English law and the customer and Kizala Ltd hereby submit to the exclusive jurisdiction of the Courts of England and Wales.
These terms and conditions do not affect your statutory rights.
